Acceptable Use Policy

This Acceptable Use Policy ("AUP") governs your use of the Aergos Service and is incorporated into the Terms of Service by reference. Capitalized terms not defined here have the meaning given in the Terms.
Violation of this AUP is a material breach of the Terms. We may suspend or terminate any Account for AUP violation, with or without prior notice, in our sole discretion. Accounts terminated for AUP violation forfeit any remaining Subscription time and Pack balances, without refund.
1. You must not use the Service to:
1.1 Violate law or third-party rights
- Engage in activity that is illegal under applicable U.S. federal law, the laws of New York, or the laws of any jurisdiction in which you operate.
- Infringe the intellectual-property, privacy, publicity, or contractual rights of any third party.
- Generate, publish, or distribute content that defames, harasses, or stalks any person.
- Promote or facilitate illegal drug distribution, human trafficking, child sexual-abuse material (CSAM), or violence against persons or groups.
1.2 Generate or distribute harmful content
- Create or distribute unsolicited bulk email, SMS, or other messaging (spam), or use the Service to facilitate spam campaigns by others.
- Generate deceptive content intended to impersonate a real person, organization, or public figure without clear authorization.
- Generate misleading medical, legal, financial, or other advice that a reasonable user could mistake for professional counsel, without appropriate disclaimers.
- Create content designed to manipulate search engines in a way that violates those engines' published guidelines (e.g., Google's Webmaster / Search Essentials), including but not limited to cloaking, hidden text, doorway pages, and deceptive redirects.
- Generate content that harasses, threatens, or incites violence against any individual or group.
1.3 Attack the Service or other users
- Attempt to access, probe, or scan the Service or its systems beyond your authorized scope, including penetration testing without our prior written consent.
- Attempt to bypass, disable, or interfere with security, rate-limiting, authentication, or usage-metering features.
- Upload, transmit, or generate malware, viruses, worms, ransomware, or other harmful code.
- Engage in denial-of-service attacks, resource exhaustion, or other conduct that materially degrades Service availability for other users.
- Attempt to reverse-engineer, decompile, or extract source code of the Service except as permitted by applicable law.
1.4 Target sites or data without authorization
- Use the Service's crawling, analysis, or integration features to target any website, web property, or third-party service for which you do not have the owner's authorization. You are responsible for ensuring you have the right to connect, crawl, or analyze any resource you instruct the Service to process.
- Use OAuth or API credentials obtained by deception or without the account owner's consent.
- Violate any third-party provider's terms of service when connecting that provider (including Google, WordPress, SEMRush, DataForSEO, and the AI Providers listed in the Terms).
1.5 Circumvent Service limits or billing
- Create multiple Accounts or use deceptive identity information to obtain additional Trial periods, free-tier benefits, or Pack discounts.
- Share Account credentials with unauthorized persons.
- Use automation, bots, or scripts to exceed normal human usage patterns except via our documented API and within stated rate limits.
- Engage in chargebacks without first attempting to resolve the dispute with Aergos support (see Terms § 17.1).
1.6 Misuse AI features
- Generate content for categories prohibited by the AI Providers' own terms (including but not limited to sexual content involving minors, bio-chem-nuclear weapons instructions, detailed self-harm instructions, or detailed instructions to commit violent crime).
- Strip, obscure, or misrepresent AI attribution where the AI Providers' terms require disclosure of AI involvement.
- Use the Service to generate high-volume, low-quality content ("content spam") that violates search-engine webmaster guidelines or which a reasonable person would consider designed primarily to game rankings rather than serve users.
- Attempt to extract Aergos's system prompts, proprietary prompt engineering, or internal configuration.
1.7 Other prohibited conduct
- Use the Service to compete with Aergos or to build a competing product, service, or model.
- Publicly benchmark or publish the Service's performance, quality, or availability without our prior written consent.
- Misrepresent your affiliation with Aergos.
- Engage in conduct that, in our reasonable judgment, threatens the integrity, reputation, or lawful operation of the Service.
2. Content transparency for AI Output
Where the Service generates AI Output that you publish to the public (e.g., to your website, blog, or social channels), we encourage — and in some jurisdictions may require — reasonable transparency that AI was involved in producing the content. You agree to comply with any applicable disclosure requirements, including jurisdiction-specific AI-transparency laws that may apply to your publication.
3. Reporting abuse
If you believe another Account is violating this AUP, or if you receive spam, impersonation, or harmful content you believe originated through the Service, please report it to [email protected] with as much detail as possible (message headers, URLs, screenshots).
4. Enforcement
4.1 Our rights
Aergos may, at its sole discretion:
- Investigate suspected violations.
- Request information from an Account holder to resolve a report.
- Issue warnings.
- Suspend features or throttle usage.
- Terminate Accounts immediately, with or without notice.
- Delete content that violates this AUP.
- Cooperate with law enforcement on matters involving suspected illegal activity.
- Preserve user data as required by lawful process.
4.2 Effect of termination for AUP violation
Accounts terminated for AUP violation:
- Lose access to the Service immediately upon termination.
- Forfeit the remainder of any paid Subscription period, without refund.
- Forfeit all unused and unexpired Pack balances, without refund.
